The Board of Directors of CIDCO have approved the proposal of freezing the Reserve Prices of Land in various nodes of Navi Mumbai via Board Resolution No 12412 Dated 17th April 2021.

New Drama before elections

Recently we witnessed new drama before elections when CIDCO Chairman, Sanjay Shirsaat, a political appointee, a Shiv Sena MLA in Maharashtra Legislative Assembly from Aurangabad West Vidhan Sabha constituency, enacted a drama orchestrated by a group called ‘Navi Mumbai Citzen’s forum’ in co-ordination with other groups called Sahakar Bharti, The Navi Mumbai Co-Operative Housing Federation and Navi Mumbai Vyapari Mahasangh along with ex Shiv Sena member and ex IAS officer Vijay Nahata, who went on to fight the latest assembly elections on an independent ticket later.
Most people are unaware that CIDCO Chairman is a political party leader.
They think he is the owner and ruler of CIDCO and whatever he says is the law.

The drama began suddenly just before the elections, when a group called ‘Navi Mumbai Citizens Forum’ sprang up from nowhere and started demanding cancellation of the CIDCO Transfer charges. Their Twitter page was set up in January 2022 and it is headed by BJP IT Cell Maharashtra Head Satish Nikam. So in all probability, this is just a front organization of the BJP, but the name of the organization makes it appear as if its a group of ordinary citizens of Navi Mumbai.

Then another news was flashed that a proposal would be finalized in the next 8 days and another party member Vijay Nahata jumped into the bandwagon and started spreading news that the proposal had been passed by the CIDCO board and that a Govt resolution would be passed soon.

All this gave an impression that the proposal had been passed and that CIDCO Transfer charges had been cancelled.😂

The most important points that the press hid from you :

  • CIDCO Transfer charges cannot be changed by merely passing resolutions and GR’s inside some office.
  • CIDCO Transfer charges are applicable as per law and rules passed in Assembly.
  • That law is called Navi Mumbai Disposal of Lands act and Navi Mumbai disposal of land rules.
  • No official announcement was made by any IAS Directors or MD’s or Jt MD’s of CIDCO.
  • No official announcement was made on the official website of CIDCO
  • The online link for CIDCO Transfer charges are still operational 😂

With all this perfect orchestration of the drama in co-ordination with pliant media, BJP’s job was complete.
They had successfully managed to fool the people once again.

The bottom line is……….CIDCO Transfer charges have come into existence on the basis of a law called Navi Mumbai Disposal of Lands Act and Navi Mumbai Disposal of Land rules. And something that has come into existence on the basis of any law passed in assembly can only be cancelled when the same law is cancelled in the Assembly. It cannot be junked by any GR or any Cabinet note.

What did the so-called ‘press release’ say? It said …
The lease period of the land in Navi Mumbai will be extended from 60 years to 99 years. And this will only be applicable to Societies which agree to pay 20% of the Reserve price of Land (As per CIDCO price list)

Those who pay the 20% of CIDCO reserve price for their plot of land, will get their lease extended to 99 year period and will not have to pay CIDCO transfer charges during this period (Mind you, it still stays leasehold land).

Most importantly, this ‘scheme’ will be implemented only in certain areas and only for 2 years on ‘trial basis’.

Now let us examine what the CIDCO Reserve price of Land is in Navi Mumbai in Nerul. As per CIDCO records, the reserve price of land in Nerul is almost Rs 14,000 per sq meter. So 20% of reserve price of this land comes to 2,800 per sq meter.For my society (measuring 8000 sq meters) in Nerul, this comes to 2,800 X 8000 =2,24,00,000 (Two Crores twenty four lakhs)

Simple math shows that it is almost impossible for any society to cough up that much money in one shot just to avoid paying CIDCO transfer charges of a few thousand rupees for every sale and purchase of a flat (especially when that charge is borne by the purchaser and not the society 😊)

By now you are almost tearing your hair and wondering why the govt is playing these games ?
The answer is simple : CIDCO earns 300-400 crores every year via CIDCO Transfer charges.
With this money it provide services and pays salaries to its staff. If you take away this 400 crores, how will CIDCO pay its bills ?😊 This balancing of income and expenditure is known as budget.

BJP is well known now for its jumlas and this is nothing but a new jumla designed to fool people., just like all their other fake promises like abolishing toll tax in Maharashtra etc. Toll is collected by the contractor to recover his cost of constructing the road. If he is deprived of that money, he will take the govt to court and recover the money by hook or crook as everything is in writing in the contract. But such is the fate of this country that people are hardly aware of the laws and fall for blatant lies of politicians.

GST IMPOSED ON CIDCO TRANSFER IN 2014

Instead to removing the draconian 18% GST imposed on CIDCO transfer charges (which was not there before 2014) and eradicating the rampant corruption inside CIDCO, Manda Mhatre (BJP)  and Devendra Fadnavis are playing these devious games designed to fool people at election time.

What has she (Manda Mhatre) done about the rampant corruption in CIDCO ? Nothing.

Her residence is just 300 meters from the CIDCO HQ. If she claims that she does not know about the corruption, then she does not deserve to be an MLA. But knowing politicians and their capacity and capability, she may hardly have a clue about rules and procedures. The fact that she is just 4th std pass also doesn\’t help the situation

How to nail corrupt officers in CIDCO Transfer Dept

Whenever an application is submitted in CIDCO for transfer, it is allotted a CFC Number (Serial Number). According to Anti-Corruption laws, even if a govt officer gives out of turn facility (Preferential treatment) to someone or favors someone for quicker processing of files out of turn and not according to the serial number (Provided there is no objection or issue raised with the file or application) it is considered as CORRUPTION.

It is due to this very reason that CIDCO does not display the list of applicants on its website along with their CFC Numbers, even though this is public information as per RTI act. CIDCO knows that the day they start displaying the list of applicants along with their serial numbers online, they will be forced to process applications as per serial number and all their bribery will be exposed.

Remember : As per rules, CIDCO is supposed to issue you a Transfer NOC within 21 days and Mortgage NOC within 7 days.

So if you are being made to run around by CIDCO officers since you are not paying them a bribe and you are 100% sure about your documents being in order, you can complain about out of turn favors to anyone who submitted his documents after you but got his CIDCO NOC before you.
If you know for sure that somebody who submitted his application after yours but got his NOC before you, its considered as CORRUPTION under the Prevention of Corruption Act.

You can also file an online RTI asking for the serial numbers of Applications submitted to CIDCO for any particular month and their clearance date. This will give you an accurate picture of whose application got cleared out of turn. You can file an online RTI from the comfort of your home here

Every plot number and society has a file which contains all details about every member and every flat.

If the number after your number (or two) shows that the NOC has been issued, you have your evidence needed for the complaint. They will have to investigate the movement of your application from the time it was submitted. Every movement of every file at every step in CIDCO is recorded in the File movement Register (peon register) and it is very difficult (impossible) to destroy this record.

Almost every CIDCO officer will be caught for corruption if this method is deployed by any citizen.

The corruption is so blatant that its running under the very nose of the so called \’Vigilance Dept\’ located on the 6th floor of the same building !!
Any complaint to the officers is simply brushed aside or the complainant is made to do so much running around that he is forced to give up. The level of corruption going on in CIDCO has also led to murders of staff in the past.
Even the harmless looking women sitting behind counters on the first floor in the estate department are corrupt to the core. 
Looks can be really deceptive. All are heavily involved in taking money and bribes to process your files. In such a situation it can be easily said that CIDCO is one of the most corrupt organizations in the country.
In a new move, CIDCO has started charging 18% GST on All NOCs … which means every transfer/NOC will now cost thousands of rupees more This Circular was issued on 5th December 2017…and will also be sent to all who were issued NOCs after July 2017For issuing Mortgage NOC, CIDCO charges Rs 500+18% GST as processing fees

Although it cannot be assured that your complain online will be acted upon. Always file a written complaint and take an acknowledgement from the Vigilance Dept on the xerox along with the date and time. Even though the Vigilance Dept itself is a big question mark, its worth giving a shot.

CIDCO’s amnesty scheme for POA owners of its flats

CIDCO has sold flats based on a strict condition that before selling the CIDCO flats, owners will have to take permission from CIDCO and they will have to share 50% of the profit (difference between their selling price and the price at which they purchased from CIDCO) from sale with CIDCO. This gave rise to various tactics to evade these additional charges.

For example, a flat in E type apartments (3 bhk @ 1000 sq ft carpet area) which was purchased at Rs 30,000 in 1973 started fetching a price of Rs 3,00,000 in 1980,which meant that 1.5 lakhs would have to be paid to CIDCO as profit share in case the flat owner wanted to sell the flat.

Most people started selling their flat on POA (Power of Attorney), thereby depriving CIDCO and the State of massive funds.
This POA later gave rise to various other issues, due to which owners couldn’t sell their flats, couldn’t become society members, couldn’t obtain loans etc.

The Scheme

In 2011, the Govt announced an amnesty scheme wherein the defaulters could pay the set fees and penalty as a one time charge to regularize their flats in these buildings…however this was applicable only to flats purchased before June 2009 and the whereabouts of the seller (original owner) was not known (traceable).

Current Status (Legal Issues)

The scheme has currently been suspended as it involves legal issues which need to be sorted out at the Level of the Law governing all sales and purchases of flats. Giving Amnesty for all such purchases will give rise to further complications in the future. Power of attorney is only valid till the lifetime of the person who is giving it. There is no guarantee that the person who gave the Power of attorney is still alive. In that case, the transaction will become completely illegal as the Power of Attorney is invalid anyways after a person dies.
Current laws make it compulsory for the Power of Attorney regarding Flat or property purchase to be registered.
The registrar can ask for people who are parties to the old Power to Attorney to come and register the agreement but the law says that the executed (signed) agreement has to be registered within 4 months of the signature.
Also the CIDCO sale agreement specifies clearly that only direct blood relatives of the buyer can be appointed as Power of Attorney Holders.

That presents a whole new problem. The present law will have to be amended before this scheme can be implemented. But this is highly unlikely as it will give rise to unimaginable consequences legally.

Political schemes to fool people before elections

Most people are unaware that the country is governed with laws.
Laws are passed in Assembly for matters which come under state list in the constitution.
The law comes into force when it is approved by both houses and is signed by the governor and published in the Gazette.
It is for this reason that another name for politicians is LAWMAKERS. But most fool people by promising to do \’Seva\’ of people. What exactly this SEVA is … is not defined or mentioned anywhere in the constitution.
Politicians in connivance with chor bureaucrats are expert at concocting such nonsense and illegal schemes and getting it published in the papers to fool people.
They know that people wont know the truth anyways.
Fool them and take votes. To hell with what happens later.

This is the fate of the country. Where the current lot would not know abc of the law and give votes based on \’promises\’ and lies. They don\’t even know that the only job and legal duty of the politician is to make laws in the assembly and parliament. After the law is made, they can\’t even change a full stop or comma in the law.

CIDCO to give height approval on behalf of Airport Authority

CIDCO has received provisional approval from AAI (Airports authority of India) to grant height approval for buildings up to a height of 75 meters in Ulwe. As Ulwe lies directly in the flight path of the upcoming airport at Ulwe, prior sanction from the Airports Authority is required before construction. Till now the approval had to be obtained directly from the AAI, which used to cause unnatural delays. On an average, AAI approval used to take 4-6 months, but now will be possible in 20 days. The final approval will be granted by AAI itself. This is the first time that AAI has given the authority to approve the height of a building to another agency.
The height of a building is the lowest closest to the airport runway and goes on increasing upto 20 km from the runway.
75 meters is roughly equal to a 15 storied building.
Therefore,clearances for buildings upto 15 stories will be provided by CIDCO.

NMMC General Body clears 2.5 fsi for redevelopment in Navi Mumbai

There is good news and bad news for the people of Navi Mumbai who have been staying in dilapidated buildings which have been long declared unfit for habitation.
The good news is that The Navi Mumbai municipal corporation (NCP) General body meeting passed the proposal to hike the redevelopment FSI of Navi Mumbai to 2.5 for dilapidated structures and an FSI of 4 for gaothan areas and chawls.

This proposal has been hanging since 2009 and assumed larger proportions when elections are near. People of Navi Mumbai have been misled by false promises and announcements in the past. But this time the NMMC claims to have prepared a ‘fool proof’ plan prepared by none other than CRISIL.

If successful, the proposal will immediately affect more than 70 structures which have been declared unsafe.

Now for the bad news

The proposal will now go to the Urban development department of the Govt of Maharashtra, where it will be studied and its fate decided. Laws and rules regarding FSI and Development are passed in State Assembly and published in the State Govt Gazette via a Notification.

Without a Gazette Notification, even a million resolutions passed in Municipal Corporation will have Zero Effect.
The Motive behind passing this ‘resolution’ is pure fakery and deceit to fool the ignorant people who have zero knowledge about laws and procedures.

Redevelopment : The toughest nut to crack

Although redevelopment is already a tough procedure, it becomes all the more tougher as most of the CIDCO building inhabitants do not have proper ownership documents and most have \’purchased\’ the flats via Power of attorney as the sale of these flats/houses was forbidden by CIDCO for a few years after allotment. To bypass this ban, allottees often sold their flats via Power of attorneys. Most buildings have still not formed co0p housing societies and many have not paid property taxes. Most don\’t have conveyance.

For redevelopment to succeed, all these documents have to be in order.
In order to get these in order, an expense of a few lakhs cannot be ruled out.
Its anybody\’s guess as to how many residents of these low income colonies are ready to shell out that kind of cash to get their papers in order.

Until an outcome for these problems is found, redevelopment is a distant dream for most of Navi Mumbai, the approval of the Urban Development Ministry not withstanding.

Mhada Repair Scam

Maharashtra Housing and Area Development Authority (Mhada) officials and private contractors are hand-in-glove in a Rs100-crore scam concerning repairing tenders of cessed buildings, a Right to Information Act (RTI) query has revealed. Contractors try to grab the tenders by quoting prices as less as 80% to 90% below the estimated cost of repair.

However, once they get the contract, they recover the deficit — difference between the estimated repair cost and the price they have quoted — by submitting an ‘extras’ bill. They also include their profit in the bills. DNA is in possession of 68 documents which highlight the modus operandi of contractors and Mhada officials.

For example, if a contractor quotes Rs1 lakh to repair a building against its estimated cost of Rs10 lakh, he later submits bills over and above Rs9 lakh to recover the amount with the help of Mhada officials. He may or may not complete the repair work, but ensures he gets a hefty sum with some profit for Mhada officials too.

Mhada repaired a cessed building in Bhuleshwar for which the architect and engineer estimated the repairing cost to be Rs4.98 lakh. A private contractor bagged the tender by quoting Rs94,732 — 81% below the estimated repair cost. In another case, a contractor was allotted the contract after he quoted a price 90% less than the estimated cost. The lowest bidder always bags the contract.

“The contractors later recover the deficit amount and earn profit by submitting the ‘extras’ bill to Mhada. The bills are cleared by Mhada officials as their palms are greased by contractors too,” alleged Salim Shaikh, social activist and vice-president of NGO Together For Empowerment & Active Monitoring which got the documents under RTI.

Mhada deputy chief engineer (repairing cell) Arvind Dhole refused to comment. The 68 documents show that almost all work is given to the bidder who quotes an amount far lesser than the estimated repair cost. “If the estimated cost is Rs10 lakh, the contractor says the work will be done in Rs1 lakh. How is it possible? It is because of extras,” said Shaikh.
“Even the genuine contractor who misses out on the contract does not raise an objection because there is a cartel. If contractor ‘A’ gets work this time, next time contractor ‘B’ is accommodated. It is their modus operandi,” said activist Tabrez Patel.

Apart from the ‘extras’ bills, contractors also unofficially force tenants to shell out money. “No one bothers to give them a receipt. It is a racket which runs into Rs100 crore. If there is shortage of funds, money is diverted from the MLA and MP fund. So, the amount is distributed among contractors, elected representatives and Mhada officials. Many dilapidated buildings are repaired only on paper,” said RTI activist Anil Galgali.
“We have no option, but to keep paying Mhada officials and elected representatives. There is corruption at every level of the administration,” a contractor said.
